How Workers' Compensation Insurance Works

Almost all employers must, by law, carry workers' compensation insurance. It ensures that employees will get compensation for medical bills, lost wages, and other consequences if they suffer an injury at work or while doing work-related activities. They get the benefits regardless of who was at fault for the accident.

By having workers' compensation insurance, employers are protected from conventional personal injury lawsuits. However, many injured workers can sue a "third party" that was at fault for the injury. Types of Cases

Workers' compensation (a.k.a. "workman's compensation") cases can involve a huge array of injuries and accidents, including:

  • Repetitive stress disorders (carpal tunnel syndrome, tendonitis)
  • Falls causing back injuries, spinal cord injuries, closed head injuries, etc.
  • Injuries from dangerous machines

Loss of function and disfigurement - payments of benefits for permanent losses of bodily functions and scarring or disfigurement caused by workplace injuries.

Sometimes worker's compensation insurance companies refuse to make voluntary payments to injured workers. In such cases, the workers should consult with an attorney who can pursue the claim promptly.

While insurance companies are required to, and frequently do, make voluntary payments following a work place accident, injured workers may require an attorney to:

  • Assure that the proper amount of benefits are paid to the worker;
  • Defend against attempts by insurance companies to reduce or discontinue benefits;
  • File claims for medical benefits, when insurance companies deny claims for treatment, surgery or prescription medication;
  • Determine the amounts payable for losses of function and disfigurement; and
  • Negotiate a fair settlement of the claim, to permit the injured worker to provide for future needs and attempt a return to the workforce.
